Fisher & Paykel Healthcare Pty Limited (we, us, our) is pleased to announce a new F&P Shopping Spree promotion where if you purchase a new Fisher & Paykel Healthcare SleepStyle machine and mask, you could win one of 5 prizes, subject to the terms and conditions below. By completing and submitting an entry form, you agree to these terms and conditions.

1. This promotional commences at 9:00am on Monday 10th December 2018 and entries close on 5.00pm on Friday 11th January 2019

2. To be eligible to participate in this promotion and prize draw you must:

• be a resident of Australia over the age of 18 years

• purchase a new Fisher & Paykel Healthcare SleepStyle Auto or CPAP device and any Fisher & Paykel Healthcare mask from a Fisher & Paykel Healthcare Authorised  Dealer or Pharmacy (in Australia only) between 10th December 2018 and 11th January 2019

• not be a Fisher & Paykel Healthcare employee; an immediate family member of a Fisher & Paykel Healthcare employee; a director, officer or employee of any company associated with the Promotion or the immediate family member of such person.

• complete and submit the official Promotion Entry form to the Fisher & Paykel Healthcare Authorised Dealer or Pharmacy (in Australia only) by 5.00pm on 11th January 2019.

3. Only one entry into the prize draw is allowed per person.

4. Five prizes will be awarded to five individual winners. Each prize comprise a $1,000 Shopping spree in the form of an Eftpos card (valued at $1,000).

5. All completed entry forms with accompanying proof of purchase must be submitted by our authorised Dealer or Pharmacy – either via our OSA Sales representatives or via post – and received at Fisher & Paykel Healthcare’s head office located at 19-31 King Street, Nunawading, Victoria, 3131, Australia by 5.00pm on Monday 21st January 2019.

6. The random prize draw will take place at 1.00pm on Tuesday 22nd January 2019 at Fisher & Paykel Healthcare’s head office located at 19-31 King Street, Nunawading, 3131, Australia. Entrants are not required to be present at the time of draw. At this time, a multiple draw will take place whereby 5 consecutive draws will be made for each of the 5 prizes to be supplied. The total prize pool value is $5,000.

7. Prize winners will be advised via writing and phone using the contact details provided on the entry form within 5 working days of the random draw.

8. Each winner’s last name, initial of first name and Dealer location, will be published within 7 days of the draw on our website at www.fphcare.com/shopping-spree-winners following the draw and notification of winners.

9. If, despite all reasonable efforts to contact the prize winners, there are any unclaimed or unawarded prizes, we reserve the right to re-draw the unclaimed prize(s) at the location above at 1pm on Tuesday 5th February 2019. Prize winners from this random re-draw will be advised via writing and phone using the contact details provided on the entry form within 5 working days of this draw.

10. We will not be responsible for any entry forms that are incorrectly completed or that are misdirected, late, lost, stolen or damaged.

11. We reserve the right to substitute a prize if an original prize is unavailable due to circumstances beyond our control. Any substituted prize will be of the same or greater value than the original prize.

12. Prize winners will bound by any Terms & Conditions which are stipulated by the business or organisation providing the prizes.

13. We will collect, store and use any personal information you provide to us (as it appears on the entry form) for the purposes of conducting this promotion only and otherwise in accordance with the Privacy Act 1988 and our Privacy Policy (see www.fphcare.com.au/about-us/privacy-policy/). If you do not provide us with your correct name and contact details on the entry form we may not be able to contact you in the event you are drawn to win a prize.

14. We reserve the right to withdraw, alter or change the promotion or these terms and conditions at any time due to any circumstances beyond our control that affects our ability to conduct the promotion or if we suspect any abuse, misuse or fraudulent activity in connection with the promotion.

15. Nothing in these terms will limit or exclude any rights you may have under the Australian Consumer Law in relation to the promotion. Except for any such rights you may have under the Australian Consumer Law (or any other law) which cannot by law be excluded, we hereby exclude all other warranties or guarantees, whether express or implied and howsoever arising, in relation to the promotion.  To the extent permitted by law, we will not be liable to you or any third party for any loss or damage suffered by you or a third party in connection with the promotion or in connection with your use or acceptance of any of the prizes.
